| 1. | 受版權保護的多媒體資料，由香港特別行政區政府 (「政府」)擁有版權，或由多媒體資料版權擁有人（「特許人」）給予政府特許使用權。
Regarding the Materials which are subject to copyright, either the copyright is owned by the Government of Hong Kong Special Administrative Region ("the Government") or the rights to use are licensed to the Government by the respective copyright owners of the Materials ("the licensors"). |

| 2. | 使用者只獲准自由查閱、收聽或檢視原有格式的多媒體資料，作個人和非商業用途。如欲以未經「使用條款」准許的方式或用途使用多媒體資料，應事先尋求政府或特許人的書面准許。有關多媒體資料的版權事宜，請以電郵方式(電郵地址hkcl_ref@lcsd.gov.hk)向我們查詢。
Permission is granted to you only to freely browse, listen to or view in its original format an item of the Materials for personal and non-commercial use. If you intend to make use of any items of the Materials in any manner or for any purposes other than those permitted under the Terms of Use, prior written permission should be sought from the Government or the licensors. For enquiries about the copyright status of the Materials, please contact us by e-mail at hkcl_ref@lcsd.gov.hk. |
| 3. | 除非根據「使用條款」另行批准，或事先得到政府或有關多媒體資料特許人的授權書，否則嚴禁以下任何行為，包括但不限於複製、印刷、改編、發布、修改、上載、傳送、轉發、商業開發、印行或向公眾提供多媒體資料。
Unless otherwise permitted under the Terms of Use, or unless prior written authorization is obtained from the Government or the relevant licensors of an item of the Materials, any acts including but not limited to reproduction, printing, adaptation, dissemination, modification, uploading, transmission, retransmission, commercial exploitation, publication, or making available of the Materials to the public are strictly prohibited. |
| 4. | 為免生疑問，上文第3段所述的准許並不適用於與多媒體資訊系統連結的第三方網站的資料版權。如欲使用第三方網站的內容和資料，必須取得該網站所需的准許。
For the avoidance of doubt, the permission in paragraph 3 above does not extend to the copyright of the materials on any third party websites linked from the MMIS. Permission has to be obtained as required in the third party websites for the use of such content and materials separately. |
| 5. | 不得更改、重編、傳送、租用、轉售、以串流方式轉播或修改多媒體資訊系統的任何多媒體資料，亦不得以多媒體資訊系統的多媒體資料為基礎創作衍生作品。
You must not alter, recompile, transmit, rent, resell, re-stream or modify any Materials from the MMIS, or create derivative works based on Materials from the MMIS. |
| 6. | 使用者必須為侵犯版權所引起的一切法律後果負上全責。
You are reminded that you will be held fully responsible for any legal consequences arising from any infringement of copyright. |

| 7. | 康樂及文化事務署會代表政府盡力確保多媒體資訊系統網站的內容準確可靠，但不會對所提供資料的準確可靠作出明示或隱含的保證。政府對閱覽或使用該網站全部或部分內容所招致的任何損失或損害概不負責。
Whilst the Government acting through the Leisure and Cultural Services Department endeavours to ensure the accuracy and reliability of the content of the MMIS website, no express or implied warranty is given as to the accuracy and reliability of the information provided. The Government accepts no responsibility for any loss or damage arising from access to or use of all or any part of the content of this website. |
| 8. | 政府保留權利，可隨時和不時經通知或不經通知，修改、暫停或中止多媒體資訊系統或其任何部分。使用者同意政府無須為修改、暫停或中止多媒體資訊系統而向其本人或第三方負上法律責任。
The Government reserves the right at any time and from time to time to modify, suspend or discontinue the MMIS or any part thereof with or without notice. You agree that the Government shall not be liable to you or to any third party for any modification, suspension or discontinuance of the MMIS. |
| 彌償 Indemnity | |
| 9. | 對於因為或就使用者違反「使用條款」及／或任何指稱及／或聲稱使用者使用多媒體資料而侵犯任何一方的版權所引致的任何訴訟、訟費、申索、索求、損害賠償、費用及開支（包括按彌償基準計算的法律費用）或任何性質的法律責任，使用者同意向政府作出彌償，並使政府持續免受損害。
You agree to indemnify the Government and keep the Government harmless from any actions, cost, claims, demands, damages, costs and expenses (including legal fees on an indemnity basis) and liabilities of whatsoever nature arising out of or in connection with your breach of these Terms of Use and/or any allegation and/or claim that your use of the Materials infringes the copyright of any party. |
